Share Expense Terms and Conditions
1. PreambleThe use of this website known as ‘Share Expense’, together with the software and services, shall be referred to below as the Service.
2. Acceptance of the Terms and Conditions
2.1 In order to use the Service you must first agree to the Terms and Conditions of Service set out below. You may not use this Service if you do not accept these Terms and Conditions.
2.2 To accept the Terms and Conditions simply click the box marked ‘Agree and Submit’ on the register page. Once you have clicked this box you will be deemed to have understood and accepted all Terms and Conditions.
2.3 You are invited and advised to print off a copy of the Terms and Conditions for your records.
3. Share Expense and the Service provided.
3.1 Share Expense agrees to provide you with a personal account after you have unconditionally accepted the Terms and Conditions of Service. The account will provide you with the opportunity to contact any person hosting an advert, in confidence, via the internal messaging system. This means that you will not need to disclose your email address. The account will also enable you to host an advert. For the hosting service you may be required to pay a fee. The price for hosting an advert, will depend upon which hosting package you choose. For full details on ‘Hosting Packages’ go to the help page.
3.2 Share Expense will not participate in negotiations, or any other communications entered into by users of the Service.
3.3 Share Expense cannot and does not guarantee that a user or host of the Service will find a suitable sharer. Share Expense only provides the facility for potential introductions and acts as an electronic notice board.
3.4 Share Expense shall not refund any monies paid to Share Expense for hosting an item, under any circumstances.
3.5 You agree that your account with Share Expense will permit you to host an unlimited number of adverts at any time. You may delete hosted adverts at any stage prior to the expiry of the term agreed within the chosen ‘Hosting Package’. The Service will automatically delete your hosted advert at the expiry of the term of the agreed ‘Hosting Package’ without notice.
3.6 Share Expense agrees that it shall not intentionally disclose any personal information about yourself, such as your name or contact details, to a third party, without your consent. For further information on privacy, see the privacy policy at www.shareexpense.com/privacypolicy.php.
3.7 Share Expense will use its best endeavours to provide a quality service for its customers. In the course of performance reviews, Share Expense may choose at any time to change the form and nature of the Service without prior notice to you. Your general agreement to the Terms and Conditions denotes your express acceptance to any such changes.
3.8 As part of ongoing business appraisals and reviews, you agree that Share Expense may stop (permanently or temporarily) providing the Service (or any of the features of the Service) to you or others generally, at the sole discretion of Share Expense without prior notice to you.
3.9 Share Expense will have sole discretion to terminate immediately any unlawful or suspected unlawful use of the Service or any use of the Service that may bring the reputation of Share Expense into disrepute.
3.10 Share Expense will not tolerate or permit, any form of gambling, pyramid or referral type schemes to be advertised or operated via use of the Service.
3.11 Share Expense will immediately terminate any use of the Service which is suspected to relate to the provision of sexual services or sex industry products and articles.
3.12 The display of photographs or images with any sexual content via use of the Service, will result in the immediate termination of the account.
3.13 You agree that Share Expense may immediately terminate your use of the Service if you are to be in breach of or suspected to be in breach of any of the Terms and Conditions of Service.
3.14 You acknowledge and agree that if Share Expense disables or terminates your account, you may be prevented from accessing the Service together with your account details or any files or other content contained in your account.
3.15 The Service will not back up your data and cannot guarantee being able to restore lost data.
3.16 The Service will not take any responsibility for non-deliveries, wrong deliveries of messages or any service interruption, however it may be caused.
3.17 The Service has complete discretion to terminate an account if it believes or suspects that any messages or communications are offensive or potentially offensive.
4. Your use of the Service
4.1 You agree that in the course of using this service it will be necessary for you to provide personal information about yourself, including contact details. You agree that such information will be accurate, correct and up to date. You agree to update this information with Share Expense if any changes occur during use of the Service.
4.2 You agree to use the Service only in accordance with English Law. This includes the laws relating to the exporting of data and copyright.
4.3 You agree to use the Service only in accordance with the Terms and Conditions.
4.4 You agree that you are solely responsible for the ‘content’ and wording of your account at all times, including the hosting of your advert. ‘Content’ relates to data files, written text, computer software, music, audio files, or other sounds, photographs or videos.
4.5 You agree not to access or attempt to access any of the Service by any means other than through the interface provided by Share Expense.
4.6 You agree not to engage in any activity that interferes with or may disrupt the Service or the servers or networks connected to the Service.
4.7 You agree not to reproduce, duplicate, copy, sell, trade or resell the Service or the idea of Share Expense.
4.8 You agree that you are solely responsible for adhering to the Terms and Conditions and shall not authorise any third party to utilise the Service in your name.
4.9 You agree to be solely responsible for any breach by you, of the Terms and Conditions however caused and for any consequential loss and damage that may arise from any such breaches.
4.10 You understand and agree that you have sole legal responsibility for any consequential loss or damage arising from any breach of agreement reached between yourself and via use of the Service between you and a third party.
4.11 Restrictions on use of the Service You agree that in using this Service you will not:
- Be offensive, menacing, threatening, abusive, or defamatory;
- Act in breach of copyright, confidence, privacy or any other rights;
- Infringe any other person’s copyright, patent or trademark, trade secret or other proprietary rights or rights of publicity or privacy;
- Be fraudulent or be involved with the sharing of any unlawfully obtained, counterfeit or stolen item;
- Be obscene, indecent, or offensive.
- Send any messages containing computer viruses, macro viruses, Trojan horses, worms, or any other electronic device designed to destroy, interfere with or disrupt the normal operating of any other computer.
- Intercept or attempt to intercept or access any other part of the Service or internal data base not made available on the public website.
4.13 You agree that you will act lawfully at all times and that the ‘content’ of your account, including your URL gallery, will only contain material to which you are lawfully entitled.
5. Proprietary rights
You agree that Share Expense owns all legal rights and interests in the Service including any intellectual property rights subsisting in the Service, whether registered or not.
6. General Disclaimer
6.1 Share Expense is not a party to any agreement formed between users of the Service and bears no legal responsibility towards any persons who meet or form legal relations via the use of the Service.
6.2 Share Expense is not legally responsible for any breaches of contract or other failures arising from communications between users of this service and cannot be held legally liable for such breaches or failures under any circumstances.
